Basically any municipality that tries to enact gun laws that exceed state laws are open to outside lawsuits:

This is good. Hopefully this will stop places like Philadelphia and Pittsburgh from enacting their own extra regulations.  Cudos to the governor and the PA state legislature for doing this.

Eh..as a resident of Philadelphia it falls into the category of stupid gun stuff.

This legislation was probably aimed at Phillly, where we were trying to stop people from doing things like buying 50 crappy handguns and selling them for a profit on a street corner.  Definitely a different problem than is encountered in more rural areas. Not taking a side on this one, but folks should keep in mind that that rural and urban firearm issues are different.

Doesn't pa already have preemption? or something like that? No town can create laws stricter than state level?

Are you saying it is legal to sell handguns on a street corner elsewhere in PA but Philly wants to make it illegal and this law will stop that?

Philadelphia already is a "city of the first class" in PA, the only one in PA, which already gives it more restrictive gun laws.  Not sure for now but in the 1990s Philly residents had a harder time getting carry permits.  Ironically, *my* permit was good there, however.  They don't need more gun laws.

Quick summary of PA firearms laws:

Some key points:
- no guns are allowed in courthouses or school property
- open carry is legal statewide except in Philly or in a vehicle
- concealed carry permit is required to carry a rifle or shotgun within Philadelphia and during a declared state of emergency
- there already is a state preemption law in place
- the new law allows lawsuits against local municipalities trying to enact further laws/regulations
- all records of firearms purchases have to be destroyed within 72 hours of the background check
- PA has castle doctrine and stand your ground laws

Nullify gun control via the courts and lawsuits against municipalities infringing upon the RKBA.   Finally using the Progressive's own tactics against them.  I love it!    ;D

Thats great news!  Virginia did the same a few years back, with the exception of the Federalies restrictions, all towns and cities, etc  cannot exceed state law.

Previously, some cities said you cannot have a gun in a park, etc.. etc..  That meant for a CCW, a *MULTITUDE* of "no gun zomes" could be cobbled up by a locality.

With preemption, they cant do this... except with state approval and with good reason.

Anyway, its a GOOD thing for the gun owner!

The NRA is suing Pittsburgh, Lancaster and Philadelphia for ignoring the pre-emption laws:

It's fantastic as we now have a weapon against politicians enacting unconstitutional laws.

Virginia has one more "weapon." If a locality loses a preemption case, the locality must pay for the person's legal fees. This provides an incentive for the locality to inform its police that they are strictly prohibited trying to enforce anything that would fall under preemption because the town would have to pay when they lose.
