Tide is turning on conceal carry in California
« on: February 13, 2014, 10:32:10 PM »
Wow, looks like we may be getting back our right to carry a weapon here ?

http://news.yahoo.com/gun-rights-federal-judges-rule-against-calif-restrictions-011846019.html

The court ruled that since open carry is illegal, they cant keep concealed carry a "must show a reason" . The judge said one or the other must be available per second ammendment !

I predict the 9th Circus will hear the case en banc and reverse the three member panel's decision.  It ain't over until the Supreme Court rules.

Definitely a positive note.
But, we have a long way to go to get back our gun rights in Cali.

It ain't over until the Supreme Court rules.
It might not be appealed because of the fear of just that. If the S.C. rules in our favor on this, Cali & every other restrictive state will be screwed.
I think the gun grabbers might wait to get the court stacked in their favor.

Regardless of whether this case is appealed, the SCOTUS will eventually have to take up carry of a firearm outside the home. Thanks to this case and the twin cases of Moore v. Madigan and Shepard v. Madigan in the 7th Circuit, you have at least two circuits saying that carry outside the home is covered by the Second Amendment. By contrast, the 2nd, 3rd, and 4th Circuits say it is  OK to severely restrict carry outside the home.

When you have a split like that, the Court will eventually take it up. There is a case from NJ concerning carry that has been appealed from the 3rd Circuit to the Supreme Court for this very reason.

On another note, the 9th Circuit has not issued an opinion on Richards v. Prieto which was heard as the same time as Peruta. That case is being brought by the CalGuns Foundations and the Second Amendment Foundation. That attorneys in that case are Alan Gura and Don Killmer.

And that's exactly what happened.

Californians don’t have automatic right to carry concealed weapons in public, appeals court says

Quote
...Overturning a three-judge panel’s decision, a larger group of judges from the U.S. 9th Circuit Court of Appeals said California counties may require people who want permits for concealed guns to show a specific reason why they need the weapons.

“The 2nd Amendment does not preserve or protect a right of a member of the general public to carry concealed firearms in public,” the court ruled, 7-4. ...

...the 2nd Amendment “may or may not protect to some degree a right of a member of the general public to carry a firearm openly.”

But if there is such a right, it is a right only to carry a gun openly, and that issue was not before the court, the majority said.

Californians can't carry firearms because some 14th century monarch didn't like peasants having access to them? Sounds like he was really enlightened.  We should embrace all their bans: https://en.m.wikipedia.org/wiki/Attempts_to_ban_football_games.  It is the civilized thing to do afterall.

Ha!

But, seriously, what's the likelihood this goes to SCOTUS?  And what are the risks, if they do?

Yeah. I'm frustrated. Seems like they should have to legalize some form of carry, either open or concealed. But nope!
Bad guys don't apply for ccw permits! Good guys do. Duh!

So, do you really want this to go to SCOTUS? Who's going to appoint the next justice?

http://www.foxnews.com/politics/2017/06/26/justices-thomas-gorsuch-blast-court-decision-to-reject-gun-rights-appeal.html

Quote
the court on Monday rejected a challenge out of California regarding the right to carry guns outside their homes, leaving in place a San Diego sheriff's strict limits on issuing permits for concealed weapons.

Quote
The case in question involved a San Diego man who said state and county policies requiring "good cause" -- a specific reason or justifiable need to legally carry a concealed weapon -- were too restrictive. A federal appeals court had ruled for the state, and now those restrictions will stay in place.

Let Trump replace Kennedy and Ginsburg. California will demand secession after SCOTUS rips all the 2nd amendment infringements out of their laws.

The way I see it. No matter how they decide on guns, even if they ban certain guns. The bad guys always find a way to get hold of them. So until they figure out how to keep guns out of the hands of robbers, and whatknots, this country will go to hell in a hand basket and we will have no way to protect ourselves from these robbers, home invasions, drug dealers and whatever out there. And for the mental illness. There needs to be a way to figure out who these folks are and keep them from buying guns in the first place. They need to learn how to deal with mental illness and hopefully find a way to cure some of these people. Till then the killings will never stop.
